Abstract
|
Background. The relevance of the study arises, on the one hand, from the increasing importance of historical and legal science in the context of political and global challenges and, on the other hand, from the need to study the practices of forming pension legislation in historical and comparative aspects in order to develop a strategy for the further development of this legislation. The design of an appropriate methodology is the first step towards the historical and legal science of pension legislation in European countries. Materials and methods. The author of the study applies a wide range of methods, starting with general dialectical approach and general scientific methods (such as analysis, synthesis, abstraction, system-structural method) and ending with special scientific (sociological, statistical) and special legal (comparative legal, formal legal and other) methods. Results. Traditional and modern methodological approaches prevailing in historical and legal science are analyzed. The author's methodology for studying the historical development of pension legislation in European countries is developed. The author proposes the interpretation of methodologically significant concepts for studies, such as “Europe”, “pension legislation”, “pension provision”, “pension”. Conclusions. Since Russia is part of Europe in geographical and historical-legal terms, Russian pension legislation should be considered within the framework of historical and legal study of pension legislation in European countries. The methodology of such studies includes a set of methods of a general, general scientific, special scientific and private legal (special legal) nature. Pension legislation should be understood as a set of regulations governing issues in the field of pension insurance and state (budgetary) pension provision. In this case, a pension should be considered as a regular cash payment established by law, intended to provide material support for persons who find themselves in a situation of actual or perceived loss of ability to work due to old age, disability, loss of an income earner or due to length of service.
